How long do I have to file a personal injury lawsuit in California?

For most personal injury claims, California Code of Civil Procedure section 335.1 gives you two years from the date of the injury to file suit. There are important exceptions that shorten that window dramatically. If a city, county, transit agency, or other public entity is involved, you generally must present a written claim to that entity within six months under Government Code section 911.2. Because these deadlines are unforgiving, contact an attorney early rather than close to the deadline.

What happens if the insurance company says the crash was partly my fault?

California follows a pure comparative negligence rule. Unlike states that bar recovery once you cross a fault threshold, California lets you recover even if you were mostly at fault, with your award reduced by your percentage of responsibility. That is why adjusters work so hard to assign you blame early, and why we handle the communications, gather the independent evidence, and challenge inflated fault percentages before they harden into a lowball offer.

What if the driver who hit me had little or no insurance?

It happens constantly in Los Angeles. As of January 1, 2025, California's minimum liability limits rose to $30,000 per person, $60,000 per accident, and $15,000 for property damage, which is still far below the cost of a serious injury. We examine every available source of recovery, including your own uninsured and underinsured motorist coverage, medical payments coverage, an employer's policy if the at-fault driver was working, a rideshare company's commercial policy, and any third party whose negligence contributed to the crash.
