For most personal injury claims, California Code of Civil Procedure section 335.1 gives you two years from the date of the injury to file suit. There are important exceptions that shorten that window dramatically. If a city, county, transit agency, or other public entity is involved, you generally must present a written claim to that entity within six months under Government Code section 911.2. Because these deadlines are unforgiving, contact an attorney early rather than close to the deadline.
California follows a pure comparative negligence rule. Unlike states that bar recovery once you cross a fault threshold, California lets you recover even if you were mostly at fault, with your award reduced by your percentage of responsibility.
